Selective TSBME justice

This week the TSBME fined doctor LaBlanc $5000 and placed her on a 5 year Probation because her husband, Dario Juarez, a PhD in Psychology and Hypnotherapy was called doctor in her practice. Juarez served as a medical assistant at times. The Medical Practice Act allows a physician to delegate tasks that the physician feels the delegated person is able to do safely.How many times have you heard a Physical Therapist or male Medical Assistant or Male Nurse called doctor by patients. How many times have you heard of a Female Doctor called nurse by a patient.Beware: Big Brother might be fining you $5000 because patients call your male nurse doctor or PA.http://www.themonitor.com/SiteProcessor.cfm?Template=/GlobalTemplates/Details.cfm&StoryID=6838&Section=ValleyA few miles up the Rio Grande River,Board Member David Garza DO office facility was closed on an emergency basis by the Department of Health because patients were being exposed to Dangerous Levels of Radiation by his equipment.How much was the Board Member fined for being a danger to his patients and the Public? How much was he fined for his failure to properly supervise the people for whom he was responsible? How was doctor Dr. Garza disiciplined by the Board for being responsible for a condition which was a danger to patinets and the public? Does Dr. Garza's immunity extend to questionable medical practices? Should the public expect Board Members to be disciplined the same way that the people they regulate? Why wasn't this breech of Good Medical Practices and Safe Conditions Publicized in the TSBME Report??? Who is ultimately responsible for notifying the Board of a Serious Public Health Problem created by one of its members?Is endangering large numbers of patients and the public with dangerous radiation a worse infraction than false claims and representations in advertising in which David A. Kleiman F4167 was fined $25,000 and publically repremanded. How much was Garza's fine? Why did he not get a public repremand? Why is there no mention of this in his National Practitioner Data Bank FIle.Is it right for the Board to fine and adversely affect 78 doctors this month and continue to overlook this menace? How much is his Fine? If false advertising is worth $25,000? Surely endangering the public with dangerous levels of radiation is worth 3 or 4 times that. How long is his Probabation? How much continuing education in Radiation Safety was he Required to take? Is the board afraid to give equal justice to members of this private club? Should we expect Board members to be exemplary?This behaviour by the Board Sickens me!
